Ryszard Legutko, head of the delegation of Law and Justice in the European Parliament, argues that Tusk violated the European Code of Good Administrative Behaviour by saying words in favour of President Bronisław Komorowski while on a visit to Gdańsk on 15 May.

In a letter to European Ombudsman Emily O'Reilly, Legutko has claimed that Tusk broke at least two articles relating to abuse of power and impartiality and independence.

During his visit to Gdańsk, five days before the first round of the presidential election, Tusk spoke to journalists prior to taking part in forum discussion on Europe.

Maybe I shouldn't do this, but I have decided that I ought to comment on what is happening in our country during the election campaign,” Tusk announced.

He then proceeeded to praise the incumbent president.

“We can all see that Bronislaw Komorowski was, is and, I hope, will be a very good president,” Tusk said.

Komorowski had been a member of the Civic Platform party while Tusk was in his first term as prime minister. The former had to shed his membership of the party when he became president in 2010.

Ultimately, Komorowski lost the second round of the May 2015 presidential election to Law and Justice candidate Andrzej Duda. (nh)
